Terms and Conditions
1. About These Terms
These Terms and Conditions (“Terms”) govern all services supplied CapThis Australia (ABN 21 808 317 161) — referred to in these Terms as “CapThis Australia”, “CapThis”, “we”, “us”, or “our”. By making a booking or otherwise engaging our services, you (the “Client”) agree to be bound by these Terms in full.
These Terms apply to all services offered by CapThis Australia, including but not limited to photo booth hire; professional photo booth setup (including backdrop and props) and mobile content creation.
2. Bookings & Reservations
A booking is confirmed only upon receipt of the required deposit (see clause 3). By paying the deposit, the Client confirms that they have read, understood, and accepted these Terms in full.
Bookings are accepted on a first-come, first-served basis. Submitting an enquiry does not reserve a date or constitute a confirmed booking; a date is secured only once the deposit has been received and cleared.
3. Deposits & Payments
A non-refundable deposit of fifty percent (50%) of the total booking fee is required within three (3) days of the invoice date to secure the Client’s event date.
The remaining balance is payable in full no later than three (3) weeks prior to the event date.
A refundable prop bond of one hundred dollars ($100 AUD) is held at the time of booking to cover any damage to our props or equipment. This bond is refunded in full within 48 hours post-event, provided no damage has occurred (see clause 11).
All prices are quoted in Australian Dollars (AUD). Accepted payment methods will be confirmed at the time of booking and set out on the invoice provided.
Late payment may result in cancellation of the booking at the discretion of CapThis Australia, in which case clause 4 applies.
4. Cancellations
Because we reserve the Client’s date exclusively and frequently decline other bookings for the same date, no refund is available for cancellations made within three (3) weeks of the event.
Requests to cancel more than three (3) weeks prior to the event will be considered at the sole discretion of CapThis Australia and may be subject to fees reflecting costs and preparation already incurred. In all cases, the deposit remains non-refundable as set out in clause 3.
5. Postponements
The Client must notify CapThis Australia of any request to postpone at least three (3) weeks prior to the original event date.
If we are available on the proposed new date, the original agreement and deposit will transfer to that date at no additional cost, subject to any materials or preparation costs already incurred.
If we are not available on the proposed new date, a credit to the value of the amount already paid will be issued. This credit is valid for twelve (12) months from the original event date.
6. Overtime & Late Coverage
Unless otherwise agreed in writing, all services conclude at 12:00 am (midnight).
Coverage extending beyond midnight attracts a late accommodation fee of two hundred and fifty dollars ($250 AUD), invoiced separately and payable within three (3) weeks of the event.
Where the Client requests additional operating time beyond the booked duration, overtime is charged at one hundred dollars ($100 AUD) per hour. Overtime charges will be invoiced and are payable within fourteen (14) days of the event date.
7. Confirmation & Final Consultation
For all bookings, a confirmation call is scheduled once the 50% deposit has been received. This call confirms the finer details of the event, including your theme, preferred backdrop, props, and the desired setup location at the venue.
A final consultation call will be scheduled with the Client or their event coordinator no later than fourteen (14) days before the event. This call confirms setup requirements, venue access, the event schedule, and any special requests.
8. Access & Venue Requirements
The Client is responsible for ensuring safe, clear, and direct access to the venue for both setup and pack-down.
For venues not located on the ground floor, lift access must be provided. Where no lift is available, a flat labour fee of one hundred dollars ($100 AUD) applies for the manual handling of equipment via stairs. Alternatively, the Client may arrange suitable on-site assistance, confirmed with CapThis Australia in advance.
CapThis Australia reserves the right to decline, delay, or modify the service where access conditions are unsafe. Any delay caused by restricted or unsafe access will not extend the booked service duration.
9. Setup Location & Weather
We strongly recommend an indoor setup for all photo booth services. Outdoor setups are permitted; however, the Client acknowledges the associated risks, including heat, cold, wind, rain, and variable lighting. In the event of an outdoor setup, the Client holds the responsibility to provide a stable floorspace/area for the photobooth services to take place.
CapThis Australia will provide you and/or your event co-ordinator with the set-up requirements for each photo booth/equipment (i.e., floor/ceiling clearance information, power outlet, prop-table space, etc.).
In extreme weather, we reserve the right to request relocation to a safe, sheltered area. We are not liable for reduced performance, or for any inability to operate, caused by environmental conditions beyond our control.
10. Permits & Parking
The Client is responsible for obtaining any permits, council approvals, or permissions required for the event venue.
Where paid parking is required, the Client agrees to cover parking costs for the full duration of the service, including setup and pack-down. Any parking costs incurred by CapThis Australia is the responsibility of the Client, unless otherwise mutually discussed.
11. Equipment & Liability for Loss or Damage
The Client accepts full responsibility for any loss, theft, or damage to CapThis Australia equipment caused by guests, venue staff, or environmental conditions. This includes, but is not limited to, the booth, printer, camera, backdrops, props, prop table, lighting, cords, and power boards.
No food or beverages are permitted within the photo booth area, and the Client agrees to communicate this to their guests.
In the event of any spill, stain, or damage, CapThis Australia will assess the item and notify the Client before departing the event. The $100 prop bond will be withheld, and, in cases of significant damage, the reasonable cost of repair or replacement will be invoiced and is payable within fourteen (14) days.
If damage is not identified before our departure from the event, CapThis Australia accepts responsibility for that damage and will not pursue any claim against the Client in respect of it.
12. Venue Rules & Compliance
CapThis Australia will comply with all applicable venue rules and restrictions, including those relating to equipment placement, power usage, noise levels, load-in and load-out procedures, and operating hours.
Where venue rules limit or prevent our operation, we are not responsible for any resulting reduction in service or loss of usage time. Any negotiation with the venue in respect of such rules is the sole responsibility of the Client.
13. Cooperation & Conduct
The Client and their guests are expected to cooperate with CapThis Australia attendants and to follow reasonable instructions. We are not responsible for missed photo opportunities or service interruptions caused by a lack of cooperation, or by obstruction or interference from guests or venue staff.
In the event of an emergency, or where illegal or illicit activity is taking place, or where there is an immediate risk to the safety or security of CapThis Australia staff, props, or equipment, CapThis Australia reserves the right to cease the service and leave the premises. In such circumstances, no refund will be payable.
14. Attendant Meals
For events exceeding four(4) hours, the Client agrees to provide a warm meal and water for each on-site attendant. This ensures continuous coverage without interruption. Meals should be provided at approximately the same time as guest meals are served.
15. Lighting & Flash
Our photo booth operates using flash or spotlighting. External lighting sources — such as DJ strobes, venue lighting effects, and guest phone flashes — may occasionally interfere with image quality. We are not responsible for distortion, glare, or missed moments caused by lighting conditions beyond our control.
16. Post-Production & Gallery Delivery
The digital gallery is delivered via Google Drive within twenty-four (24) to forty-eight (48) hours of the event, unless otherwise stated. The gallery remains accessible for thirty (30) days, after which it expires. Clients and guests are encouraged to download their images promptly.
17. Content Usage & Privacy
The Client’s content usage preference is confirmed via the booking form, email or SMS/Text. Subject to their selection, the Client authorises CapThis Australia to use event photos, videos, and content for promotional purposes only.
No content featuring individuals under the age of eighteen (18) will be shared publicly without the Client’s explicit written permission.
Where the Client selects “No”, or notifies us in writing, no content from the event will be shared publicly. Where the Client selects “Yes – no faces shown”, we will ensure that any content shared does not clearly identify individuals. In the case where the Client selects “Yes – faces shown”, we will ensure that any content shared is appropriate.
Our Clients are our priority. If for any reason you are not comfortable with content that has been published, please contact us at info@capthis.com.au and we will work with you to remove it within fourteen (14) business days. All privacy requests will be respected and actioned promptly.
18. Liability & Force Majeure
If CapThis Australia is unable to provide the booked services due to illness, injury, emergency, or other circumstances beyond our reasonable control, we will make all reasonable efforts to arrange a suitable replacement. Where no replacement is available, our liability is limited to a full refund of amounts paid.
In the event of equipment failure or loss of digital files beyond our control — including corrupted memory cards, power outages, or hardware malfunction — our liability is limited to a refund of the booking amount. No further compensation will be payable.
19. Governing Law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
